Bountiful Reviews an Internal ADU at Staff Level and a Detached One Differently

Bountiful currently sends an internal ADU to staff and a detached ADU to the Administrative Committee. On October 1, Utah law changes the detached path for qualifying residential lots, so a plan started now has to account for both the published city code and the effective state rule.

The current Bountiful process and the October state rule do not line up
Bountiful's website and Chapter 14 currently classify a detached ADU as a conditional use reviewed by the Administrative Committee. Internal units are permitted uses reviewed by city staff. That is the rule on the city's public materials as of August 25, 2026.
Utah Code section 10-21-304 becomes effective October 1. For a detached ADU on a qualifying lot in a primarily residential zone, the statute says a municipality may not require a conditional-use permit. It also requires specified municipalities to permit detached ADUs on lots of at least 11,000 square feet containing a permitted single-family dwelling.
That does not mean the rest of Bountiful's standards disappear. Building, fire and health code still apply. Setbacks, parking, access, utilities and privacy still shape the plan. It means anyone filing around the effective date should verify which city application path has been updated before paying for a packet built around the old process.
Bountiful's buildable-land test is more useful than the parcel area alone
The current detached-ADU rule requires at least 8,000 square feet of buildable land, not simply an 8,000-square-foot tax parcel. Elsewhere in Chapter 14, residential buildable area must sit on ground with less than a 30% slope and remain outside setbacks and easements. That distinction matters in a foothill city.
A detached unit must be between 350 and 1,250 square feet, meet the setbacks for an accessory structure, sit behind the front building line and place doors, stairs and windows as far from adjoining properties as reasonably possible. The owner must occupy the main dwelling or ADU, one additional off-street parking space is required and the ADU cannot have a separate utility meter.
Those are drawing constraints. The site plan has to show that the unit fits on buildable ground. Elevations need to make privacy review straightforward. Utility and parking choices need to be resolved before the application reaches the committee or staff desk.
An internal unit has a shorter land-use path, not a lighter life-safety standard
Bountiful reviews an internal ADU at staff level, but the plan still needs a legal separation between units. The city calls for a dedicated exterior entrance or a common entry with separate doors to each unit. Bedroom windows and exterior doors need compliant egress, and smoke and carbon-monoxide protection must be addressed.
A recorded deed restriction is required before occupancy and, when a building permit is required, before the permit is issued. The property has to retain the appearance of a single-family dwelling, and short-term rentals of 30 days or less are prohibited under the current internal-ADU section.
For an existing basement, the as-built is the first deliverable. It records room dimensions, windows, stairs, mechanical space and the current exit path so the proposed set is based on what is actually there.

Bountiful drafting and ADU questions
Does Bountiful allow detached ADUs?
Yes. Under the city's currently published process, a detached ADU is a conditional use reviewed by the Administrative Committee. Utah Code section 10-21-304 takes effect October 1, 2026 and bars a conditional-use requirement for qualifying detached ADUs in primarily residential zones, so the city process should be rechecked for any application filed near or after that date.
How large can a detached Bountiful ADU be?
Bountiful's published Chapter 14 sets a detached ADU range of 350 to 1,250 square feet and requires at least 8,000 square feet of buildable land. The unit must meet accessory-structure setbacks and sit behind the front building line of the main home.
Does the owner have to live on the Bountiful property?
Yes. The current city code requires the owner to occupy the principal unit or the ADU as a permanent residence. Proof may include voter registration, vehicle registration, a driver's license or county assessor records.
Can a Bountiful ADU use a separate utility meter?
No. The published city code does not permit a separate utility meter for the ADU. Utility routing should be resolved during design instead of left for a plan-check correction.
What is different about an internal Bountiful ADU?
An internal ADU is reviewed by city staff rather than the Administrative Committee. It needs a dedicated entrance or properly separated common entry, compliant bedroom egress, smoke and carbon-monoxide protection, one additional off-street parking space and the required recorded deed restriction.
Where are Bountiful planning applications submitted?
